Transportation to get to work to pay for living expenses might also be considered a necessary item; a court would have to determine this. A contract can only be disaffirmed while the individual is a minor. After the person reaches maturity, if the contract continues, the former minor is considered to have ratified the contract and is now bound by the contract terms. A person may ratify by signing something, or by continuing to abide by the contract making payments, for example. If a minor seeks to void a contract, he or she must return any property purchased. In the second example above, the minor must return the car if he or she cannot keep up the payments. The minor may also have to pay restitution for any damages to the property. If a minor enters into a contract, the parents are not a party to the contract and may not be held liable if the minor doesn't fulfill the contract terms. But if a parent or both parents co-sign a contract along with the minor, the contract is valid, and they are bound by the terms. Rice University OpenStax. Sam Houston State University. Otherwise, if someone sold a store and then opened another one just like it a few blocks away, the old customers would likely return to the old vendor. The general rule is it must be part of the sale of a business. Procedural Unconscionablity : Here the classic example is the contract by adhesion, loaded with the legalese no one understands. Basically a take it or leave it type of situation, which is discussed in another chapter later.Exculpatory Clauses : here we are talking about writing into a contract the ability for one side to release themselves automatically from any form of liability resulting from an accident, loss of money, or similar such damaging situation no matter who was at fault. Generally these clauses are not enforced and generally these type of clauses are contrary to public policy. However, not always, like we learn in the law. Others include requiring someone to perform a tort, interfere with a public official, and or delay prevent or obstruct the legal process.Generally, the illegal contract is VOID. Of course, there are exceptions:. Justifiable ignorance of the facts: what do we mean here? A good example is a transportation company unknowingly transports some illegal materials and incurs costs, etc, and as such should be compensated for their efforts.Personal Finance. Your Practice. Popular Courses. What Is Disaffirmance? Key Takeaways Disaffirmance is the right for one party to renounce a contract. The person must indicate that they will not be bound by the terms outlined in the agreement expressly or implicitly.People who can prove they lacked the capacity to enter a legally binding contract and minors can disaffirm a contract. A minor may rightfully disaffirm any contract into which they enter, whether or not it has already been performed. Compare Accounts. By forcing an animal to leave early, the plant may be able to ensure that its seeds will be deposited far enough away to avoid inbreeding, competition, and pathogens as mentioned above. Fruit appearance. Although toxin content limits ingestion of fruit, appearance can both limit and encourage it. Fruit appearance provides salient cues for recognition of fruit as a food source. Pigments such as carotenoids, flavonoids, and betalains give fruits their colors, and volatile compounds provide odors. In general, bird-dispersed fruit are red or black, and mammal-dispersed fruit have distinctive odors. The morphology size and shape of a fruit may also influence forager choice. Animals are limited to food items small enough to fit in their mouths and throats, especially birds and reptiles that tend to swallow fruits whole. In addition, birds may also consider the bulkiness of seeds when choosing fruit. Not only does seed bulk take up space in the digestive tract, it also may need to be jettisoned before flight. Nutrient content. Finally, fruit nutrients may be important in influencing forager choice. For most temperate fruits, energy in the form of sugars is the most abundant nutrient.Other vitamins and minerals may also be influential. For example, rose hips are known to be high in vitamin C. Nutrients may be more indirect in effect than appearance. The fruiting display must balance maximizing gains from attracting effective dispersers while minimizing losses from also attracting ineffective dispersers. Thus, we can determine the effectiveness of a fruiting display by the number of seeds successfully dispersed per effort for the entire fruit crop. For example, if the animal selects fruit on the basis of energy content, then effort is the amount of kilojoules of energy of the entire fruit crop. Effectiveness is then measured in units of numbers of seeds dispersed successfully relative to the amount of energy of the fruit crop.In conclusion, foraging behavior is an important component of the plant-seed disperser interaction. As with pollen and seeds, fruits also act as agents of dispersal. Some may be carried away by the wind. Many attract animals that will eat the fruit and pass the seeds through their digestive systems, then deposit the seeds in another location.Cockleburs are covered with stiff, hooked spines that can hook into fur or clothing and hitch a ride on an animal for long distances. The cockleburs that clung to the velvet trousers of an enterprising Swiss hiker, George de Mestral, inspired his invention of the loop and hook fastener he named Velcro. Privacy Policy. Skip to main content. Seed Plants. Search for:.Evolution of Seed Plants. The Evolution of Seed Plants and Adaptations for Land The evolution of seeds allowed plants to reproduce independently of water; pollen allows them to disperse their gametes great distances. Learning Objectives Recognize the significance of seed plant evolution. Key Takeaways Key Points Plants are used for food, textiles, medicines, building materials, and many other products that are important to humans. The evolution of seeds allowed plants to decrease their dependency upon water for reproduction. Seeds contain an embryo that can remain dormant until conditions are favorable when it grows into a diploid sporophyte. Seeds are transported by the wind, water, or by animals to encourage reproduction and reduce competition with the parent plant. Key Terms seed : a fertilized ovule, containing an embryonic plant sporophyte : a plant or the diploid phase in its life cycle that produces spores by meiosis in order to produce gametophytes pollen : microspores produced in the anthers of flowering plants.Evolution of Gymnosperms Seed ferns gave rise to the gymnosperms during the Devonian Period, allowing them to adapt to dry conditions. Learning Objectives Explain how and why gymnosperms became the dominant plant group during the Permian period.Key Takeaways Key Points Seed ferns were the first seed plants, protecting their reproductive parts in structures called cupules. Seed ferns gave rise to the gymnosperms during the Paleozoic Era, about million years ago.Gymnosperms include the gingkoes and conifers and inhabit many ecosystems, such as the taiga and the alpine forests, because they are well adapted for cold weather. True seed plants became more numerous and diverse during the Carboniferous period around million years ago; an explosion that appears to be due to a whole genome duplication event. Key Terms cupule : any small structure shaped like a cup gymnosperm : any plant, such as a conifer, whose seeds are not enclosed in an ovary mutualism : any interaction between two species that benefits both.Evolution of Angiosperms Angiosperms, which evolved in the Cretaceous period, are a diverse group of plants which protect their seeds within an ovary called a fruit. Learning Objectives Discuss the evolution and adaptations of angiosperms.Dispersal is complete when the animal picks off the offending burr, hopefully dropping it in a new location suitable for growth. As grazing deer or antelope walk over them, the spines catch around the animals' feet. When the animal finally gets annoyed and shakes the fruit off, dispersal is complete. Whitson Home. Bio Home.
